Terms of Service

These Terms of Service ("Terms") govern access to and use of the Oviee website, public booking links, mobile applications, software, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.

1. Definitions

  • "Oviee", "we", "us", or "our" means the operator of the Platform.
  • "Provider" means an independent freelancer, salon, studio, or business offering services through the Platform.
  • "Customer" means a user who books or purchases services through the Platform.
  • "Booking" means an appointment reservation made through the Platform.
  • "Partner Contract" means the direct agreement between a Customer and Provider for services booked.
  • "Payment Services" means payment collection features made available through third-party processors.

2. Platform Role and Scope

Oviee provides booking, scheduling, messaging, profile, and payment-enablement technology. Oviee is not the provider of booked services. Services listed on the Platform are supplied by independent Providers. Oviee does not employ Providers and is not responsible for Provider service quality, outcomes, safety practices, licenses, qualifications, premises, or legal compliance.

3. Acceptance, Eligibility, and Capacity

  • You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Platform.
  • You represent that you can enter legally binding contracts.
  • If acting for a business, you represent that you have authority to bind that business.

4. Accounts, Security, and Accuracy of Information

  • You must provide accurate, complete, and current information.
  • You are responsible for account credentials and all activity under your account.
  • You must promptly update contact/payment details to prevent failed bookings or payment disputes.
  • We may verify account details and may refuse use of the Platform where risk checks fail.

5. How Bookings Are Formed

When a Customer submits a booking request through the Platform and receives confirmation, a Partner Contract is formed directly between Customer and Provider for the service booked. Oviee is not a party to that service contract and does not guarantee Provider availability or fulfillment.

6. Booking Rules, Availability, and Accuracy

  • All bookings are subject to Provider availability and configured booking rules (lead time, buffers, limits).
  • Service descriptions, images, and durations are provided by Providers and may vary in practice.
  • Pricing displayed at booking may change only as allowed by Provider terms and law.
  • Providers are responsible for setting accurate service details and appointment policies.

7. Payment Authorization and Collection

By confirming payment, Customers authorize charges shown at checkout, including deposits, full prepayment, no-show/cancellation charges where validly disclosed, and applicable taxes/fees.

  • Payment processing is provided by third parties (for example Stripe) and subject to their terms.
  • Oviee may collect payment on behalf of Providers where enabled by Platform settings.
  • Currency conversion, issuer fees, or bank fees are the Customer's responsibility.
  • We may retry failed charges when payment authorization exists.

8. Deposits, Reschedules, Cancellations, No-Shows, and Refunds

  • Providers may require deposits up to the maximum amount permitted by law.
  • Cancellation/reschedule cut-off windows are set by Providers and shown before confirmation.
  • Late cancellation and no-show fees may be charged where policy disclosure and consent requirements are met.
  • Refund entitlement is determined by Provider policy, applicable law, and payment processor rules.
  • Refund processing times depend on processors and issuing banks.
  • Cash or off-platform payments are outside Oviee payment protection and may not be recoverable via the Platform.

9. Platform Subscriptions, Plan Features, and Fees

Oviee may offer free and paid plans (including Pro) with feature differences. Plan pricing, billing cycle, and included features are displayed in-app or on our website at purchase time.

  • Subscription fees are billed in advance unless otherwise stated.
  • Price changes may apply on renewal with prior notice where required by law.
  • Failed subscription payments may result in plan downgrade, restricted access, or suspension.
  • Free trials and promotions are subject to specific offer terms.

10. Provider Payouts and Settlement

Provider payouts, timing, reserves, and holds are subject to Platform settings, risk controls, payment processor capabilities, disputes, and compliance requirements. Oviee may delay, adjust, or withhold payout amounts where reasonably required for fraud prevention, chargebacks, refunds, or legal obligations.

11. Public Booking Links and Marketing Features

  • Public booking links are enabled only when required profile/readiness conditions are met.
  • Providers are responsible for all content, claims, images, and offers shared through their link/profile.
  • Oviee may disable public links that violate policy, law, or safety expectations.

12. User Conduct and Prohibited Use

You must not:

  • Submit false, misleading, fraudulent, or stolen identity/payment information.
  • Abuse chargeback systems or intentionally evade valid cancellation/no-show policies.
  • Harass, threaten, discriminate against, or abuse any user, Provider, or staff member.
  • Interfere with Platform security, attempt unauthorized access, scrape data, or reverse engineer services.
  • Use the Platform for unlawful activity, money laundering, or sanctions breaches.

13. Provider Obligations and Compliance

  • Providers must maintain accurate listings, pricing, availability, and policy settings.
  • Providers are solely responsible for required licenses, consents, insurance, and legal compliance.
  • Providers are responsible for service quality, hygiene/safety standards, and client duty of care.
  • Providers must comply with applicable consumer laws for cancellations, refunds, and service delivery.

14. Communications and Notifications

By using the Platform, you agree to receive service communications (for example confirmations, reminders, payment updates, and security messages). Marketing communication preferences can be managed in settings where provided.

15. Third-Party Services and Integrations

The Platform may integrate with third-party services including payment processors, cloud infrastructure, analytics, and communications providers. Those services are governed by third-party terms and policies. Oviee is not liable for third-party service outages or acts/omissions.

16. Intellectual Property and License

  • Oviee and related marks, logos, software, and content are owned by or licensed to Oviee.
  • We grant a limited, revocable, non-transferable license to use the Platform for its intended purpose.
  • You may not copy, distribute, modify, reverse engineer, or create derivative works without permission.

17. Reviews, User Content, and Feedback

Users may submit reviews, ratings, and other content. You grant Oviee a non-exclusive, worldwide, royalty-free license to host, display, and use such content for operating and improving the Platform. Oviee may remove content that is unlawful, abusive, misleading, or violates these Terms.

18. Platform Availability, Maintenance, and Changes

We may modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted access. Planned or emergency maintenance may affect service availability.

19. Suspension, Restriction, and Termination

Oviee may suspend, restrict, or terminate accounts or access, with or without notice, where reasonably necessary to protect users, Providers, payment integrity, or legal compliance.

  • Examples include fraud indicators, repeated chargebacks/no-shows, abusive behavior, and policy breaches.
  • Providers may also restrict individual Customers from booking with their business.
  • Certain obligations survive termination (for example payment, indemnity, and dispute clauses).

20. Disputes, Chargebacks, and Recovery Rights

We may request supporting evidence for disputes, including booking logs, communications, and policy acceptance records.

  • Where chargebacks or losses arise from misuse or policy breach, Oviee may recover associated costs.
  • Oviee may offset recoverable amounts against future payouts or balances where legally permitted.
  • Dispute decisions by card networks/payment processors may affect final outcomes.

21. Disclaimer of Warranties

To the fullest extent allowed by law, the Platform is provided "as is" and "as available" without warranties of uninterrupted service, merchantability, fitness for a particular purpose, or non-infringement.

22. Limitation of Liability

To the maximum extent allowed by law, Oviee excludes liability for indirect, incidental, special, or consequential damages, lost profits, and service-outcome claims relating to Provider-delivered services. Oviee's aggregate direct liability arising from Platform use is limited to the greater of (a) amounts paid by you to Oviee in the prior 12 months or (b) GBP 100, unless law requires otherwise. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

23. Indemnity

You agree to defend, indemnify, and hold harmless Oviee and its affiliates, officers, employees, and agents from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your misuse of the Platform, breach of these Terms, violation of law, or infringement of third-party rights.

24. Privacy and Data Use

Our processing of personal data is described in our Privacy Policy. By using the Platform, you acknowledge that Oviee may process data needed to operate bookings, payments, fraud controls, and compliance workflows.

25. Consumer Rights

If you are a consumer, you may have statutory rights under applicable law. Nothing in these Terms is intended to limit rights that cannot legally be excluded or restricted.

26. Assignment

You may not assign or transfer your rights under these Terms without our written consent. Oviee may assign these Terms to an affiliate, successor, or acquirer as part of reorganization, merger, sale, or financing.

27. Entire Agreement and Severability

These Terms, together with referenced policies, form the entire agreement between you and Oviee for Platform use. If any provision is held invalid or unenforceable, the remaining provisions remain in full force.

28. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction, unless mandatory law requires a different forum.

29. Changes to These Terms

We may update these Terms from time to time. Material updates will be posted on this page with a new effective date. Continued use of the Platform after updates means you accept the revised Terms.
